1.make two tracks insert a midi item split the item at time selection engage loop recording place the split item on track 2 record an item should show up out side of the time selection (this is the bug)

I think we need a screencap or screenshot to understand what you are seeing.

Thanks for the screencap. That's very odd! It looks like you are recording audio on top of a MIDI item, which is unusual but not illegal or anything. Presumably you intend to record MIDI into the item, right? Is the behavior different if you record MIDI instead of audio? Regardless, it would be helpful if you could save the project just before you start recording and share the .rpp -- it should be very small.
